SERVICE TERMS AND CONDITIONS

Viva Viajes Machu Picchu S.A.C, hereinafter referred to as Viva Viajes, with registered office at Av. Mariano Melgar Ñ-7, Cusco – Peru, with RUC (Unique Taxpayer Registry) 20610240985, a legal entity subject to Peruvian law, duly constituted before the Peruvian State, with tax domicile in the city of Cusco – Peru, hereinafter referred to as CONTRACTOR.

AUTHENTICITY OF INFORMATION

The CONTRACTOR is solely responsible for the accuracy of the information provided and the authenticity of the documents provided by the CONTRACTOR during the purchase subject to this contract, being civilly and criminally liable for such information.

The names and documents provided will be used to issue vouchers, tickets, service orders, hotel reservations, and any other document necessary for the provision of the service. Therefore, names and documents cannot be modified once the purchase is formalized, nor can names and documents entered in error hinder or prevent boarding, check-in, or the provision of services in general by suppliers. If any of these situations occur, the CONTRACTOR will be fully responsible for the inaccurate information transmitted by the CONTRACTOR, hereby excluding the CONTRACTOR from any liability.

OBJECT:

This contract aims to provide terrestrial tourism services (combined trips), according to the itinerary chosen by the CONTRACTOR.

CONTRACTING:

The contract will be considered effective upon confirmation of payment of the package price, according to the conditions made available by the Contractor and selected directly by the Contractor with their consultant.

PAYMENT METHOD:

DOWN PAYMENT: 25% of the total package value:

– To confirm your reservation, we will send you a link with 25% of the total value of the contracted package. This payment can be made by Bank Transfer or Debit/Credit Card.

BALANCE: 75% of the total package value (paid up to 10 days before the travel date).

NOTE: We use the tourist dollar exchange rate on the day of payment.

WE RECOMMEND: Make your payment via transfer to expedite the process and allow us to proceed with ticket and hotel reservations.

Conversions are made using the tourist dollar exchange rate on the payment date.

Payments by bank transfer will only be processed once the deposit receipt has been sent and the amount confirmed in the current account.

Credit card payments will only be processed once confirmed by the supplier and approved by the card-issuing company.

The final package price will be quoted based on the number of participants. Any variation in the number of participants in the contractor’s group will also result in a corresponding modification of the final combined trip price per person.

THE PACKAGE PRICE DOES NOT INCLUDE

Personal documentation;

Travel insurance;

Beverages in general: alcoholic, mineral, soft drinks, coffee, etc.

Overnight stays and meals exceeding those established in the program or not mentioned;

Meals in transit;

Optional excursions;

Personal extras (phone calls, tips, laundry, minibar consumption, taxis, etc.).

SPECIFIC CONDITIONS FOR INTERNATIONAL TRAVEL

Restrictions on the entry or stay of the passenger or passengers in international territory will be the sole and exclusive decision of local authorities, who exercise total control over their borders, with the authority to authorize or deny entry, stay, and exit of goods and people from their territory. This is an inherent power of each State’s sovereignty, recognized by the community and international norms.

DOCUMENTATION

It is the exclusive responsibility of the CONTRACTING PARTY to consult with the consular authorities of the countries they intend to enter regarding the required documentation, as well as the requirement of consular visas, vaccines, insurance, and other specific requirements of the country and continent to be visited.

For tourists from MERCOSUR

The CONTRACTOR must present the Identity Card issued by the Public Security Secretariat of the States or the Federal District, provided it is in good condition (maximum of 10 years since its issuance) and the photograph allows the identification of the passenger, and Identity Cards issued by Classist Organizations and/or Public Ministries or Passports in good condition, within the validity period and with a minimum of six months of validity, will not be accepted.

For tourists from other foreign countries

Passports must be in good condition, have a minimum validity of six months, and contain the consular visas and vaccination certificates required by the entry country, according to the current requirements.

CHANGES.

In case of change by the passenger, an administrative fee will be charged ranging from 10% to 50% of the total value of the chosen package, depending on the advance notice of the change and subject to availability and supplier policy.

30 days before the start of services = 10% of the total package price

Between 29 and 15 days before the start of services = 20% of the total package price

Between 14 and 07 days before the start of services = 30% of the total package price

06 days or less before the start of services = 50% of the total package price.

HOTELS

The company will have the right to substitute hotels of the same category in the offered tourist packages, as VIVA VIAJES is subject to hotel availability in Peru, as provided for in Article 1277 of the Peruvian Civil Code in force.

The type of accommodation acquired and other particularities of the purchased tourist package must be stated in the Land Voucher.

SCHEDULES

Schedules during the trip must be strictly followed by passengers. The client will not be entitled to a refund if they miss an excursion or any other service provided, which is not the responsibility of our company, such as “Soroche” (altitude sickness), illnesses in general, or injuries.

It is previously established that flight delays at any point during the trip, accidents, luggage losses or misplacements are the sole responsibility of the contracted airline, and according to international regulations (Warsaw Convention), the Operator declines any responsibility for the loss of services, already paid and contracted by them, derived from flight delays and/or cancellations.

LUGGAGE AND PERSONAL EFFECTS

Luggage and other personal belongings, as well as theft or loss of documents, valuables, and personal effects during the trip, are the sole and exclusive responsibility of the contractor.

CIVIL UNREST

Peru is a politically active country, with protest models different from those of other countries. Here, strikes are widespread, preventing all sectors from working: transportation, commerce, industry, and tourism.

These protests are strict, with established schedules for the “shutdown” to take place.

VIVA VIAJES is not responsible for the loss of one or more services in case our clients face this scenario. However, we will strive to address these situations as best as possible so that our clients can enjoy their trip.

CANCELLATION

Cancellation of the travel package or service contracted by the client, as well as the cases listed below, are considered cancellations.

* The cancellation of the trip or the non-presentation of the client on the specified day and time, for any reason, including illness, will be subject to the following fines on a progressive scale, depending on the advance notice with which they are communicated according to the criteria indicated below:

  • Up to 50 days before the travel date, there will be no penalty, deducting the deposit commission and other administrative services totaling 10% of the value of the contracted package.
  • Between 39 and 21 days before the travel date = a fine of 20% of the total
  • package value.
  • Between 20 and 11 days before the travel date = a fine of 50% of the total travel package value
  • Between 10 and 07 days before the travel date = 80% fine of the total travel package value
  • Less than 7 days before the travel date = 100% fine of the total travel package value

We will have a period of up to 60 (sixty) calendar days to reimburse the amount according to the aforementioned conditions, starting from the date of cancellation of the contracted trip.

The refund amount will be credited to our account or other means of sending amounts, considering the method used by the Contractor to pay for the combined trip.

All refunds will be converted at the dollar exchange rate.

Contractors who abandon their trip or part of it once started, or do not use any of the confirmed services, regardless of the reason, will not be entitled to a refund of the amounts paid.

The cancellation request must be made via email

[email protected] or directly to the contact email address of your advisor.

The contracted services may also be canceled at any time due to fortuitous events and/or force majeure, which may include natural phenomena or cases of public calamity, war, government impositions, order disturbances, accidents, or strikes, among others, but always affecting travel services and/or endangering the Contractor and other participants in the services.

In these cases, the company will follow existing government guidelines, analyzing each case to refund the amounts actually paid.

Any CLIENT who in any way endangers or hinders the proper progress of the trip or that of other individuals (passengers or not) will be disconnected from the trip, without the right to any refund or compensation. In this case, the Contractor will assist the CLIENT in obtaining a return ticket at the earliest possible destination. Additional expenses will be the sole responsibility of the CLIENT.

LEGAL BASIS

To enforce policies, terms, and conditions and provide total legal security to the tourist during their stay in Peru, we have complied with all legal provisions required by our legislation:

A.- Political Constitution of Peru.

B.- Law 29408, general tourism law.

C.- Current Peruvian Civil Code 1984.

IMPORTANT RECOMMENDATIONS
  • We recommend acclimatizing on the day of your arrival, as we are at an altitude of more than 3000 meters, when you arrive in Cusco or another high-altitude city (such as Puno), to minimize potential altitude problems.
  • Drink plenty of fluids, add a little more sugar to your drinks, and eat easily digestible carbohydrate-rich foods. We recommend avoiding alcohol and tobacco, and it is important to drink coca tea (an ancient and traditional leaf).
  • Inform us if you have allergies, illnesses, intolerances, or any medical condition, dietary preferences, etc.
  • Consult your doctor for any additional medication.
